By accessing or using Osember ("the Service"), operated by OB Labz ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We reserve the right to update these terms at any time, and continued use after changes constitutes acceptance.

2. Description of Service

Osember is an AI Operating System that provides conversational AI assistance, memory management, custom rules, skills, and related features. The Service is provided on a subscription basis. We may modify, suspend, or discontinue any part of the Service at any time.

3. User Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must be at least 18 years old to use the Service. You must notify us immediately of any unauthorized access to your account.

4. Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the Service or its systems
• Transmit harmful code, malware, or interfere with the Service
• Use the Service to generate content that is harmful, abusive, or violates the rights of others
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Resell or redistribute the Service without our written permission

5. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by OB Labz and protected by intellectual property laws. You retain ownership of content you input into the Service. By using the Service, you grant us a limited license to process your content solely to provide the Service to you.

6. Payment Terms

Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice. If your payment fails, we may suspend access to the Service until payment is resolved.

7. Privacy

Your use of the Service is also governed by our Privacy Policy. Osember employs zero-knowledge encryption for stored data — we cannot read your encrypted content even if we wanted to.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. AI-generated responses may contain errors or inaccuracies. You should not rely on the Service as your sole source of information for critical decisions. We do not guarantee uninterrupted or error-free operation.

9. Limitation of Liability

To the maximum extent permitted by law, OB Labz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

You may cancel your account at any time. We may suspend or terminate your access if you violate these terms or for any other reason with reasonable notice. Upon termination, you may export your data within 30 days, after which it will be permanently deleted.

11. Changes to Terms

We may modify these terms at any time. We will provide notice of material changes via email or through the Service. Your continued use after the effective date of any changes constitutes acceptance of the revised terms.
